It's not a fine merely a charge for breaching their terms and conditions, there's a big difference. It's down to the parking company to prove on the balance of probabilities that a breach of the T&Cs occured and when they have done that prove that their charge and the doubling of it equates to their losses.


My guess is that firms like this very rarely pursue matters through the small claims court as they know they're on dodgy legal ground and just go after the soft targets, leaving people who ignore their threatening letters alone after a few attempts as it's not worth their while pursuing.


I'm not against parking control by the way but the fact is these companies rely on "loopholes" and people's ignorance to extract money from them, therefore it is only just that people are informed and do the same back.

"Equality of arms" as they say.
